People of Kashmir stand with Muslims of Jammu: JRL
Jammu, April 10: Jammu and Kashmir Police on Tuesday registered a First Information Report (FIR) against lawyers of Kathua Bar Association for preventing the Crime Branch from filing a charge sheet against accused in Asifa rape and murder case in the court of Chief Judicial Magistrate Kathua yesterday.
DGP Jammu and Kashmir SP Vaid confirmed that an FIR has been registered in the case.
“An FIR has been registered against Kathua bar association lawyers under sections 353 (assault or use of criminal force to deter a public servant from discharging his duty, 147 (rioting), 341 (wrongful restraint) of RPC,” said SSP Kathua Suleiman Choudhary.
On Monday, lawyers in Kathua staged a protest and prevented the Crime Branch from filing charge-sheet against the seven accused in the horrific rape and murder of eight-year-old Asifa Bani.
In its investigation, the Crime Branch has established that Asifa was raped and murdered by a few residents of Rasana and adjoining village to force the Bakerwal community to which Asifa belonged to leave the area.
Seven persons, including SPO Deepak Khajuria, SPO Surinder Verma, Sub Inspector Anand Dutta, Head constable Tilak Raj, Retired Patwari Sanji Ram and his son Vishal Kumar, and a juvenile have been arrested in the case.
Sanji Ram, a retired revenue officer, is the custodian of the Devasthan temple where Asifa was held captive for a week.
The investigation has concluded that police sub-inspector Anand Datta and head constable Tilak Raj were involved in destroying crucial evidence about the crime.
The duo was arrested after it was established that they had washed Asifa’s clothes before sending them for forensic investigations.
According to the Crime Branch officials, the viscera report of the deceased has established that she was drugged by the accused so that she would not cry for help.
“The viscera report is positive for clonazepam. This means that the victim was drugged by the accused,” they said. The medical report, according to them, has also revealed that the cause of Asifa’s death was asphyxiation.
People of Kashmir stand with Muslims of Jammu, Chenab, Rajouri and Pooch: Joint Resistance
Meanwhile, the Joint Resistance Leadership (JRL) comprising of Syed Ali Geelani, Mirwaiz Umar Farooq and Muhammad Yasin Malik described the attempt of Kathua Bar Association and certain political parties of Jammu to prevent Crime Branch from filing a chargesheet against the criminals involved in the brutal rape and murder of eight year old minor girl as shocking and morally bankrupt
Reacting to the news of lawyers in Kathua protesting against filing of charge-sheet in the Kathua rape and murder case, the JRL said that there will be hardly any place in world where efforts will be made by section of people to shield the culprits involved in a minor’s child’s rape and murder unless, there is a heinous ulterior motive involved.
“It seems that the motive of intimidation and displacement of the Gujjar community from their land which is driving these people to such shameless and highly condemnable actions,” the JRL said in a statement.
“These lawyers by creating hurdles in filing the charge sheet against the culprits is a violation of all basic principles of law, justice and humanity, which has left a big question mark on their credibility and the protest by them clearly indicates that these lawyers are working under political pressure and an agenda. This brazen act by lawyers has also taken lid off the lid of their mindset against the muslims of Jammu and Chenab region,” the statement added.
The Joint Resistance while citing the case of Nirbahya rape and murder that shook India in December 2016, stated that all political, religious and social organisations civil society activists rightly joined hands and spoke in one voice to ensure severe punishment to the culprits and justice for the victim but reverse is the case in Asifa’s where every effort is being made to shield and save the culprits by communalising this human issue of justice to a little child.
The Joint Resistance said that whether it is the issue of justice for Kathua minor, or any issue related to injustice or harassment of the people of Jammu, Chenab Valley, Rajouri and Poonch at the hands of fanatic elements who belong to a particular community, Kashmiri Leadership and the people of Kashmir will always stand by them and stand up for them.
