“HC Had Quashed His Detention In December Last Year”
Anantnag: The detention of Sarjan Ahmad Wagay alias Barkati, a charismatic crowd puller during last year’s uprising, was quashed last year by the High Court. But the police, instead of releasing him, have been shifting him from jail to jail after booking him in new cases, says his wife.
Barkati, a resident of Reban village of Shopian district, had been booked under the Public Safety Act after his arrest in October last year. He had become a household name during the uprising for his distinct style of sloganeering at mammoth pro-freedom rallies.
In December last year, the court had ordered his release. However, the police, after shifting him to Central Jail Srinagar from Kotbalwal Jail in Jammu, have been detaining him in various police stations of Shopian and Kulgam districts.
Currently, Barkati has been detained at the Srinagar Central Jail again.
“They are prolonging his detention on one pretext or the other,” said his wife Shabroza Akhtar.
She said that Barkati, according to the police dossier, had been booked in more than a dozen cases but had got bail in all.
“But if we got bail in one case, the police would file a fresh case against. Now he has more than 20 cases against him,” she said.
She added that police delays filing of FIR details in courts, which in turn delays the bail.
“My two kids have been waiting for his release since January when I told them he would be released in a day or two,” she said.
Police dossier had accused Barkati of provoking the people against the state and “delivering speeches on jihad”.
“You are a maulvi khateeb of Hanfia sect and founded Tehreek-i-Fikro-Atiqad, a religious party. You have organised various religious congregations at many places in south Kashmir and delivered speeches on jihad to provoke the people especially the youth against the Indian territory,” the dossier reads.
